Terms and Conditions of Sale
1. Definitions
In these terms and conditions:
1.1 “Book” means the printed copy of “My Journey with Guruji” and shall include all it’s Parts.
1.2 “Seller” shall mean Ambika Singhania r/o at K-9/22, DLF Phase II,Gurgaon, Haryana, India PIN -122002 having her office at B-289, DLF 4, Gurgaon, Haryana, India PIN -122002.
1.3 “Customer” shall mean an individual natural person dealing as a consumer or a company, firm, sole trader or other organization purchasing Book(s) in each case for their own use and not for resale or for any commercial purpose.
1.4 “Terms” means the terms and conditions set out in this document and (unless the context requires otherwise) includes any special terms agreed in writing between the Customer and the Seller.
1.5 “Contract” means the contract between the Seller and the Customer for the sale and purchase of the Book.
2. Conditions
2.1. Nothing in these Terms shall affect the Customers’ statutory rights as a Consumer.
2.2. These Terms shall apply to all contracts for the sale of the Book by the Seller to the Customer and shall prevail over any other documentation or communication from the Customer.
2.3. Any variation to these terms (including any special terms and conditions agreed by the parties) shall be inapplicable unless expressly agreed in writing by the Seller.
2.4. Any Book(s) sold subject to the condition that they shall not, by way of trade or otherwise, be lent, re-sold or hired out or otherwise circulated without Seller’s consent.
2.5 Apart from the above, even on consent of the Seller in writing to the customer expressly authorizing circulation of the book, the customer shall not do so in any form of binding or cover other than that in which they are published and without a similar condition being imposed on the subsequent purchaser.
3. Ordering
3.1. All orders for the Book shall be deemed to be an offer by the Customer to purchase the Book pursuant to these Terms and are subject to acceptance by the Seller. The Seller may choose not to accept an order for any reason whatsoever, without having to convey the same to the customer.
3.2. Where the Book(s) ordered by the Customer is unavailable, the Customer shall be notified and given an approximate date upto which he can wait until it becomes available.
4. Price and Payment
4.1. The price of the book shall be that stipulated on www.gurujimahraj-ki-vani.info/ on the date the Customer’s order is sent to the Seller subject only to any technical error for which Seller shall not liable.
4.2. The price stated is not inclusive of any VAT chargeable in India.
4.3. The total purchase price will be displayed in the Customers shopping cart prior to confirming the order.
4.4. The price of the book does not include the cost of postage or packing.
4.5. Seller reserves the right to amend the price of Book and also the inclusive postage and packing rates at any time although the rates applicable to any given contact of sale will be those in effect at the date the Customer’s order is sent to the Seller.
4.6. Payment of the price must be made in full at the time of ordering. The debit and credit cards accepted by the Seller are those listed on the Website on the date on which the Customer’s order is sent.
4.7. Seller shall not be responsible and the Customer has sole responsibility, for complying with any legislation or regulation governing the importation of Book(s) into the country of destination and for the payment of any import or other duties or taxes.
5. Rights of the Seller
5.1. The Seller reserves the right to withdraw the Book at any time.
5.2. Save as provided for in the preceding paragraph, the Seller shall not be liable to anyone for withdrawing the Book or for refusing to process an order.
6. Delivery
6.1. Book(s) shall be dispatched on behalf of the Seller by ‘Blue Dart’ acting as her agent. Delivery shall be made to the address specified by the Customer on the completed order.
6.2. The Seller shall endeavor to ensure that the Book(s) are delivered to all destinations within 21 working days of the date the Customer’s order is sent but the Customer agrees that delivery after this period shall be accepted.
6.3. In any event, time of delivery shall not be of the essence and the Seller shall not be liable for any losses, costs, damages or expenses incurred by the Customer or any third party arising directly or indirectly out of any failure to meet any estimated delivery date.
6.4. In the event of non availability of the Book(s), the Seller will notify the Customer.
7. Risk and Ownership
7.1. Risk of damage or loss of the Book(s) shall pass to the Customer on delivery of the Book(s) or if the Customer fails to take delivery of the Book(s), at the time when delivery would otherwise have been effected.
7.2. Title in the Book(s), only those purchased and paid in full, shall pass to the Customer on delivery of the Book(s).
8. Warranty and Liability
The Seller does not make any representations or warranties of any kind, express or implied, in relation to all or any part of the Site or the Content or any websites to which the Site is linked, and all warranties and representations are hereby excluded to the extent permitted by law.
The contents of the Site do not constitute advice and should not be relied upon in making, or refraining from making, any decision.
There is no guarantee that the Site will be free of infection by viruses or anything else which may be harmful or destructive.
To the extent permitted by law, the site hereby disclaims all liability (howsoever arising) in connection with any loss and/or damage, arising out of or in connection with any use of, or inability to use, all or any part of the Content, the Site and/or any website to which the Site is linked, or any action taken (or refrained from being taken) as a result of using any of these.
The Seller provides No warranty for the Book(s).
8.2. The Seller will not be deemed to be in breach of contact or of these Terms and Conditions of Sale as a result of any delay in its performance or failure to perform its obligations if that delay or failure to perform is due to any cause or circumstance beyond the Seller’s reasonable control including, but not limited to, postal or other carrier strikes, fire, flood and other acts of God, riot, accident, civil commotion or war.
9. Disclaimer
9.1. The Seller disclaims all responsibility and liability for the import into any country of any Book(s) which infringe any local legislation of that country.
9.2 “Although the author, publisher and seller have made every effort to ensure that the information in this book was correct at press time, the author and publisher do not assume and hereby disclaim any liability to any party for any loss, damage, or disruption caused by errors or omissions, whether such errors or omissions result from negligence, accident, or any other cause.
9.3 The Seller further, does not claim or intend to give an impression that any person can/ or will have experiences that she has described in the book”
9.4 The book is only for the customers personal reading and the seller takes absolutely no responsibility for any action(s) the customers of any kind whatsoever.
9.5. The seller does not intend to create any impression that the book(s) in any manner would have any bearing in the lives of the customers.
10. Withdrawal of Books
10.1. The Seller reserves the right to withdraw from sale any Book(s) published or previously supplied by it without prior notice or liability to the Customer.
11. Copyright, Patents, Trade Marks and other intellectual property rights
11.1. All of the copyright in the Book is the property of the Seller. Any unlawful copying, trading, pirating or unauthorized use of this Book will be construed as a breach of copyright and may result in prosecution including civil and criminal claims.
12. General
12.1. The headings in these Terms are inserted for convenience only and shall not affect the interpretation.
12.2. If any of these Terms is held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this shall not effect the validity of the remaining Terms which shall continue to be valid and enforceable to the fullest extent permitted by law.
12.3. These Terms shall be governed by and construed in accordance with laws of India and the parties hereby submit to the exclusive jurisdiction of the courts at New Delhi, India.
13. Changes to these conditions of use
13.1 Ambika Singhania reserves the right to add to or change these conditions of use. Any changes will be posted to this page and it the responsibility of the customer/ user to ensure that awareness of any such changes from time to time and they shall be deemed to accepted by use of the website.
14. User Information
14.1. The Site collects information on what pages are accessed or visited by consumers, as well as information volunteered by the consumer, such as survey information and/or site registrations. We use this information for internal review, in order to improve the content of the Site and to notify consumers about updates to the Site.
14.2. We guarantee that if you supply your postal address on-line you will only be sent the information for which you provided your address but if you do not wish to receive e-mail from us in the future, or if you wish to be removed from mailing lists, please let us know by sending an e-mail at mrsambika.singhania2012@gmail.com .
15. Links to Third Party Websites or Information
15.1 The Site may include links or information to third party Internet websites which are controlled and maintained by others. These links and information are included solely for the convenience of users and do not constitute any endorsement by us of the sites linked or referred to, nor do we have any control over the content of any such sites. The Seller has nothing to do with these links or information and the Seller shall in no manner be liable for the contents in such Third Party links or information published.
